Terms of Service

1. General

1.1. These General Terms and Conditions ("GTC") apply to participation and the associated ticket sales for the event "Elvenlight Ball", organized by the organizer: BGM GmbH, Grevenweg 93, 20537 Hamburg.
Any differing terms and conditions of the participant are not valid.

 

1.2. The organizer reserves the right to make changes and additions to these regulations. Possible changes and additions become valid when published on this website or on the event website www.elvenlightball.de.

2. Registration and conclusion of contract

2.1. Registration to participate in the event is only possible via the organizer’s website.

 

2.2. The organizer makes an offer to conclude a purchase contract with the information provided on the website. The participant accepts his offer to conclude a purchase contract by completing the order process and clicking on the "Complete registration" button in the last order form. The effective acceptance of the offer by the participant requires that the participant has filled in all required fields in the order form (each marked with "*") and accepted these terms and conditions.

 

2.3. The contract for participation in the event is only concluded after the organizer has confirmed the registration to the participants in writing via email, e.g. by sending the tickets. Changes and/or additions to the contract must be made in writing. This also applies to the cancellation of the written form clause.

3. Prices

3.1 The price stated in the certificate of participation is the final price and is binding on the participant.

 

3.2 All prices include VAT where applicable.

 

3.3. If special prices are granted for discounts (students, members of certain organizations, etc.), this will also be stated separately. If no discounts are stated, they cannot be granted. The discount must be granted upon presentation of proper proof (student ID, confirmation from the university, membership number). Proof must be provided before the start of the event. If proof cannot be provided, the participant must pay the difference between the full price and the reduced price at the start of the event in order to be entitled to entry.

4. Payment

4.1 Payment is made via the methods specified on the website. All prices are due immediately upon conclusion of the contract and no later than on the day of the event.

 

4.2. Payment by invoice:

If the participant does not pay within 10 days of receiving the invoice, the organizer can withdraw from the contract. If the organizer withdraws from the contract, the participant loses his or her right to participate in the event. The participant is responsible for any fees incurred as a result of the transfer.

 

4.3. Payment by credit card:

When paying by credit card (MasterCard, Visa), the participant will be asked to enter their credit card details during the payment process. The associated credit card account will then be charged for the ticket amount.

 

4.4. If a payment is charged back (e.g. due to insufficient funds in the account specified when ordering), the participant must compensate for any damage or expenses resulting from the chargeback. This includes in particular the bank charges and a processing fee of EUR 10.00 per chargeback for processing by the organizer.

 

In the event of an unjustified chargeback of the credit card, processing costs of EUR 40.00 will be charged.

 

In the event of a chargeback, the organizer is entitled to immediately withdraw from the contract. The participant thereby loses his right to participate in the booked event. This does not affect any further claims the organizer may have against the participants.

5. Right of withdrawal

Right of withdrawal:

According to German law (Section 312g Paragraph 2 No. 9 BGB), there is no right of withdrawal for the purchase of event tickets.

6. Withdrawal/Cancellation

6.1 If the participant withdraws from the contract, no refund will be made.

 

6.2 If the registered participant is unable to attend the event, the participant has until February 10, 2025 to provide a substitute person for participation in writing or by email.

7. Services

7.1. The scope of the contractual service within the framework of the event is determined from the information documents, the details on the event website, any registration forms available and the confirmation of participation from the organizer. In the event of contradictions and in any case, the service description in the booking confirmation is decisive.

 

7.2. If services are not provided in accordance with the contract, the participant is entitled to a remedy. Defects must be reported immediately. Claims for reimbursement of the participation fee due to services obviously not being provided in accordance with the contract must be made within 14 days of the end of the event.

 

7.3. The organizer reserves the right to appoint a substitute speaker in exceptional cases. The participant will be informed of any changes in good time.

 

7.4 Travel, accommodation and meals are not included in the event offer, unless services of this type are expressly listed in the event description. If a contracting party does not make use of properly offered services in whole or in part, there is no entitlement to a refund of the participation fee.

8. Cancellation of the event

8.1 For urgent reasons, the organizer may cancel the event with reasonable notice. This also applies to supporting and evening programs.

 

8.2. If the event is cancelled, the organiser will refund the full amount paid within 14 days. Any additional costs incurred by the participant will not be refunded.

9. Copyright and other rights

9.1. The lectures and event documents issued are protected by copyright and may only be used for personal use. Rights of use are only transferred through an express written grant of rights of use. Duplication, distribution, processing or public reproduction of any kind is generally not permitted and requires the written permission of the organizer.

 

9.2. Audio and video recordings and descriptions of the event and the event results in whole or in part are permitted. Personal rights apply.

10. Images/Photographs

10.1. The participants of the event irrevocably and free of charge agree that the organizer is entitled to create, reproduce, send or have sent, and to use in audiovisual media, image and/or sound recordings of their person that go beyond the reproduction of a current event.

11. Liability

11.1. The organizer is liable for any breach of essential contractual obligations for intent and negligence. The amount of liability is limited to the amount of the participant fee; liability for consequential and financial losses (e.g. loss of profit) is excluded.

 

Claims under the Product Liability Act;

Claims due to fraudulent conduct by a contractual partner;

Claims arising from liability for guaranteed procurement characteristics;

Damages resulting from injury to life, body or health

11.3 Furthermore, the organizer and his vicarious agents are not liable for disruptions of any kind caused by circumstances beyond their control.

 

11.4 Liability for damages occurring during travel to and from the event locations, as well as for losses and accidents, is excluded to the extent permitted by law.

12. Final provisions

12.1. The law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Munich.

 

12.2. Should individual provisions of this contract be invalid or lose their validity due to a circumstance occurring later, the validity of the contract shall otherwise remain unaffected. The invalid contractual provisions shall be replaced by a provision that comes closest to what the contracting parties would have wanted if they had considered the relevant point. The same applies to gaps in this contract.

 

12.3. The place of performance is the registered office of the organizer.
